Can a Constitutional Amendment itself be fundamentally unconstitutional?
Assuming that everything is above board--that is to say that the Amendment was proposed properly, ratified properly, etc (all i's dotted and all t's crossed)--would it still be conceivable that the Amendment could be struck down for going too far?
Say an Amendment that bans free speech entirely or does away with the need for warrants in searching. Would these just be "valid" changes to the document or could they conceivably be struck down by the Supreme Court as being too in-conflict with the intent and remainder of the Constitution? Would such a ruling even be within the court's scope and power?
We can change the Constitution, but we normally do so in a what that expands the rights of the people contained therein (e.g., 13-15th Amendments for example) or that refine the procedures and powers of the government entity itself (e.g., 22nd and 25th Amendments), not in a way that restricts or even withdraws entirely rights from the people (the 18th being a notable exception, but one that was subsequently overturned).
If we did try to change the Constitution in the direction of restricting or eliminating certain rights from the people, would that act itself be considered legitimate and Constitutional?
